Access to Justice: A Foundation for Thriving Communities
At United Way South Africa, we believe that strong communities are built when every person has the opportunity to live with dignity, access opportunities, and overcome barriers that prevent them from reaching their full potential. One of those barriers, often overlooked is access to justice.
Justice is about far more than courtrooms and legal proceedings. It is about protecting people's rights, preserving their dignity, strengthening families, securing livelihoods, and ensuring that every individual has access to the support they need during life's most challenging moments.
As a Board Member of United Way South Africa and Director of Sibeko Incorporated Attorneys, I have witnessed first-hand how unresolved legal challenges can affect every aspect of a person's life. When people are unable to access legal support because of financial constraints or a lack of information, the consequences often extend beyond the individual and impact entire families and communities.

When a Legal Problem Becomes a Community Problem
For someone facing unfair dismissal, unlawful eviction, a maintenance dispute, domestic violence, discrimination, or identity documentation challenges, the inability to obtain legal assistance can quickly become a life-altering crisis.
Legal challenges affect far more than a person's immediate circumstances. They influence:
- Household income and financial security
- Children's education and future opportunities
- Safe and stable housing
- Family wellbeing
- Physical and mental health
- Community stability and resilience
This is why access to justice is not simply a legal issue—it is a community development issue.
United Way South Africa's mission is to mobilise the caring power of communities to improve lives by advancing Education, Financial Security, Healthy Communities, Community Resilience, and Youth Opportunity. Helping people understand their rights and connect with appropriate legal support strengthens each of these focus areas.
Why Justice Matters
Justice creates opportunity.
When people understand their rights and know where to seek help, they are better able to:
- Protect their employment and household income.
- Access education and essential government services.
- Escape abusive or unsafe situations.
- Resolve disputes fairly.
- Strengthen family wellbeing through maintenance and family law support.
- Participate confidently in society.
Communities become stronger when individuals have confidence that they can access fair processes and appropriate legal support.
Rights Mean Little Without Access
South Africa's Constitution guarantees equality, dignity and access to justice.
However, constitutional rights become meaningful only when people are able to exercise them.
Many South Africans continue to face barriers such as:
- Limited financial resources
- Distance from legal services
- Lack of awareness of available assistance
- Language barriers
- Complex legal processes
Removing these barriers requires collaboration between government, legal professionals, civil society organisations, businesses and community-based organisations.
Where South Africans Can Find Help
Fortunately, a number of institutions provide affordable or free legal assistance.
Legal Aid South Africa
Legal Aid South Africa offers legal advice and legal representation to qualifying individuals who cannot afford private legal services.

Typical matters include:
- Unpaid debts
- Rental disputes
- Property damage

Legal representation is generally not required.
Community Advice Offices and Paralegal Services
Community Advice Offices provide practical support by helping community members:
- Understand their legal rights
- Complete forms
- Draft letters
- Access referrals
- Resolve issues relating to grants, identity documents, housing, labour matters and public services
These services bring justice closer to communities.
University Law Clinics
Many South African universities operate supervised law clinics offering legal assistance in matters such as:
- Family law
- Labour disputes
- Consumer protection
- Housing
- Maintenance
- Estates
- Human rights
Pro Bono Attorneys and Public Interest Organisations
Many attorneys and advocates dedicate professional time to providing free or reduced-cost legal services, particularly in matters involving:
- Constitutional rights
- Gender-based violence
- Discrimination
- Education rights
- Social justice
- Social security
Specialised Forums
Many disputes are resolved outside traditional courts through specialised forums including:
- CCMA
- Bargaining Councils
- Maintenance Courts
- Equality Courts
- Magistrates' Courts (Domestic Violence matters)
Choosing the appropriate forum often saves time and resources.
Practical Steps When You Need Legal Assistance
If you experience a legal problem:
- Record exactly what happened, including dates and relevant information.
- Collect supporting documents such as contracts, payslips, receipts, letters and court papers.
- Act quickly where deadlines apply.
- Contact Legal Aid South Africa, a Community Advice Office, University Law Clinic or a qualified attorney.
- Ask which legal forum is most appropriate for your matter.
Seeking assistance early often results in better outcomes.

Leadership extends beyond professional success.

Together We Can Strengthen Access to Justice
Every South African deserves access to justice regardless of financial circumstances.
Whether through volunteering your expertise, supporting organisations that provide legal assistance, sharing reliable information or advocating for accessible services, each of us has a role to play.
When people understand their rights and know where to seek help, justice becomes more than a constitutional promise, it becomes a pathway to stronger families, resilient communities and a more equitable South Africa.
Together, we can help ensure that every individual has the opportunity to learn, earn, live healthy lives and thrive with dignity.
